O ARAYARA Amazon Climate Hub<\/strong> recebeu, na tarde desta ter\u00e7a-feira (11), uma essencial roda de conversa sobre o Direito \u00e0 Consulta e ao Consentimento Livre, Pr\u00e9vio e Informado (CCPLI) e o papel estrat\u00e9gico dos Protocolos de Consulta<\/strong>. O debate, aberto ao p\u00fablico, reuniu pesquisadoras ind\u00edgenas do IDGlobal e o Observat\u00f3rio dos Protocolos de Consulta, destacando que a consulta n\u00e3o \u00e9 mera formalidade, mas um processo pol\u00edtico fundamental para a autodetermina\u00e7\u00e3o<\/strong> dos povos.<\/p>\n\n\n\n

O CCPLI \u00e9 regulamentado pela Conven\u00e7\u00e3o 169 da Organiza\u00e7\u00e3o Internacional do Trabalho (OIT), em vigor no Brasil desde 2003, e exige que toda medida legislativa ou administrativa \u2013 p\u00fablica ou privada \u2013 que possa afetar povos ind\u00edgenas, quilombolas e demais comunidades tradicionais seja submetida a uma consulta.<\/p>\n\n\n\n

Protocolos de Consulta: Um Mecanismo de Autonomia Comunit\u00e1ria<\/strong><\/h3>\n\n\n\n

As pesquisadoras do IDGlobal, que s\u00e3o tamb\u00e9m representantes de suas comunidades, trouxeram a perspectiva de quem vive a realidade dos impactos. A\u00edla Monteiro de Oliveira, pesquisadora ind\u00edgena pernambucana, enfatizou a import\u00e2ncia dos Protocolos de Consulta como um instrumento de defesa comunit\u00e1ria.<\/p>\n\n\n\n

\u201cAs comunidades precisam ser consultadas independente desse protocolo, mas no nosso pa\u00eds os protocolos s\u00e3o um mecanismo para que a pr\u00f3pria comunidade coloque as normas que devem ser respeitadas dentro desse territ\u00f3rio,\u201d explicou A\u00edla.<\/p>\n\n\n\n

Ela refor\u00e7ou que o Protocolo de Consulta \u00e9 um documento constru\u00eddo pela pr\u00f3pria comunidade \u2013 em portugu\u00eas ou l\u00edngua nativa \u2013, que define as regras e os modos de vida que devem ser respeitados pelos empreendimentos e governos. A iniciativa e as decis\u00f5es sobre o formato e conte\u00fado devem ser sempre das comunidades.<\/p>\n\n\n\n

O Desafio de Traduzir o Direito “Branco”<\/strong><\/h3>\n\n\n\n

A complexidade de aplicar o direito ocidental nas realidades coletivas dos povos tradicionais foi um ponto central na fala de Amirele Porto Machado, pesquisadora do povo Guarani Kaiow\u00e1 e Terena (MS) pelo IDGlobal.<\/p>\n\n\n\n

Amirele apresentou o projeto “L\u00edngua Ind\u00edgena Viva no Direito”, que traduz a Constitui\u00e7\u00e3o Federal para tr\u00eas l\u00ednguas ind\u00edgenas (Tikuna, Kaingang e Guarani Kaiow\u00e1), utilizando a consulta pr\u00e9via para guiar o processo.<\/p>\n\n\n\n

\u201cA comunidade em si trouxe o questionamento de como traduzir o direito branco para que fizesse sentido na l\u00edngua ind\u00edgena,\u201d relatou Amirele.<\/p>\n\n\n\n

Ela trouxe o exemplo da l\u00edngua Guarani, onde a palavra terra possui um significado muito mais amplo do que no portugu\u00eas, evidenciando as lacunas do direito individualista que se choca com a l\u00f3gica coletiva dos territ\u00f3rios.<\/p>\n\n\n\n

Consulta e Justi\u00e7a Energ\u00e9tica na Amaz\u00f4nia<\/strong><\/h3>\n\n\n\n

J\u00falia Soares, tamb\u00e9m pesquisadora do IDGlobal, trouxe exemplos de como a aus\u00eancia ou falha na consulta pr\u00e9via est\u00e1 diretamente ligada \u00e0 justi\u00e7a energ\u00e9tica. Ela citou o programa de Universaliza\u00e7\u00e3o Energ\u00e9tica, como o “Luz Para Todos”, na regi\u00e3o do Xingu.<\/p>\n\n\n\n

Segundo J\u00falia, muitas vezes a chegada das concession\u00e1rias e do governo federal aos territ\u00f3rios ocorre com uma comunica\u00e7\u00e3o falha<\/strong>. Isso resulta em instala\u00e7\u00f5es que n\u00e3o respeitam os costumes locais, equipamentos sem manuten\u00e7\u00e3o e, crucialmente, endividamento em massa<\/strong> das fam\u00edlias por falta de compreens\u00e3o sobre a pol\u00edtica p\u00fablica.<\/p>\n\n\n\n

A pesquisadora destacou que o monitoramento do programa “Luz Para Todos” no Xingu levou 16 povos a elaborarem uma carta conjunta, denunciando o n\u00e3o cumprimento do seu Protocolo de Consulta e exigindo que suas demandas fossem atendidas.<\/p>\n\n\n\n
